On May 22, 2026, HUD issued a memo on assistance animals. The HUD memo indicates that untrained emotional support animals do not automatically qualify for reasonable accommodations under Fair Housing rules and guidelines. While this change in the federal law means at the federal level a landlord need waive pet rent, pet deposits, or accept an emotional support that does not meet other pet guidelines, Arizona has not changed their position on emotional support animals.
Landlords in Arizona should continue to consider emotional support animals in fair housing requests, and in most cases it will likely be reasonable to waive pet deposits, pet rent and consider an emotional support that may not meet the pet guidelines of a property.
