In February of this year HUD made a rule change that went into effect, April 1, 2026. As of April 1, 2026 you are not required to send the 30-day HUD nonpayment notice for HUD backed housing such as Section 8. You may simply use the regular nonpayment notice forms.

For a property with a federally backed mortgage in Pima County or Flagstaff you need to do the 5/30 day notice. For all other properties just the regular 5-day notice for nonpayment of rent with residential properties and the 7-day notice for nonpayment of rent for mobile home parks.

As a reminder, you must send a copy of all notices you send to the tenant to Section 8, including nonpayment notices. Accepting payment from Section 8 does not qualify as acceptance of a partial payment.
